Welcome to Spills Tea, operated by Yardworks Labs, LLC ("we," "us," or "our"). By using the Spills Tea service, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the service.

1. Service Description

Spills Tea is a web-based platform that enables users ("Creators") to create AI-generated questionnaires ("Asks") and invite participants ("Responders") to contribute answers and insights. Creators describe what they want to learn, and the service uses artificial intelligence to generate questions, conduct conversations, and summarize responses.

Creators interact with Spills Tea through the web application, including creating Asks, managing invitations, and reviewing responses. Responders receive a shareable invite link and participate by texting a code to the Spills Tea phone number, after which an AI assistant conducts the questionnaire over SMS.

2. SMS Terms & Conditions

This section applies specifically to Responders who participate in Asks via SMS.

By providing your phone number and opting in to an Ask, you consent to receive SMS text messages from Spills Tea related to that Ask, including but not limited to:

  • Questions and conversation prompts from the Ask you have been invited to
  • AI-generated follow-up questions for clarification
  • Confirmation and status messages related to your participation

Message Frequency: Message frequency varies by session. You may receive up to 10 messages per Ask session, depending on the nature of the conversation and any follow-up questions.

Message and Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan.

Opt-Out: You can opt out of receiving messages at any time by replying STOP to any message from Spills Tea. After opting out, you will receive a one-time confirmation message. You will no longer receive messages unless you opt in again.

Opt-In: You may opt back in at any time by replying START to the Spills Tea number or by accepting a new Ask invitation.

3. Eligibility

You must be at least 13 years of age to use Spills Tea. If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian.

4. User Responsibilities

By using Spills Tea, you agree to:

  • Provide accurate information, including a valid phone number (for Responders) or valid account information (for Creators)
  • Not use the service for harassment, spam, or any unlawful purpose
  • Not attempt to reverse-engineer, disrupt, or abuse the service
  • Respect other participants in any Ask you are involved in

5. Creator Responsibilities

Creators are responsible for the prompts they submit and the Asks they distribute. Creators agree not to use the service to collect sensitive personal information (such as Social Security numbers, financial account numbers, or health information) unless explicitly supported by the platform. Creators are responsible for informing Responders about the purpose of their Ask.

6. AI-Generated Content

Spills Tea uses artificial intelligence to generate questionnaires, facilitate SMS conversations, and summarize responses. AI-generated content, including questions, follow-ups, and summaries, is provided for informational purposes and may not always be accurate. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

7. Intellectual Property

All content, branding, and technology associated with Spills Tea are the property of Yardworks Labs, LLC. Responses you provide via SMS remain your own, but you grant us a non-exclusive, royalty-free license to use, process, and display your responses within the context of the service (e.g., presenting aggregated or summarized results to the Creator who initiated the Ask).

8. Privacy

Your use of Spills Tea is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

9. Disclaimers

Spills Tea is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, Yardworks Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to any charges incurred from SMS messages.

11. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the service or by posting the updated Terms on our website. Continued use of the service after changes constitutes acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or terminate your access to Spills Tea at any time, for any reason, including violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
