Terms of Service

Welcome to Spills Tea, operated by Yardworks Labs, LLC ("we," "us," or "our"). By using the Spills Tea service, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the service.

1. Service Description

Spills Tea is a web-based platform that enables users ("Creators") to create AI-generated questionnaires ("Asks") and invite participants ("Responders") to contribute answers and insights. Creators describe what they want to learn, and the service uses artificial intelligence to generate questions, conduct conversations, and summarize responses.

Creators interact with Spills Tea through the web application, including creating Asks, managing invitations, and reviewing responses. Creators may also receive email notifications when responses arrive; every such email includes an unsubscribe link. Responders receive a shareable invite link and participate by sending the invite's code to Spills Tea — by SMS text message (U.S. phone numbers) or via WhatsApp — after which an AI assistant conducts the questionnaire over that messaging channel.

2. SMS Terms & Conditions

This section applies specifically to Responders who participate in Asks via SMS. SMS participation is currently available for U.S. phone numbers only; if your number is international, you can participate via WhatsApp (see Section 3).

By providing your phone number and opting in to an Ask, you consent to receive SMS text messages from Spills Tea related to that Ask, including but not limited to:

  • Questions and conversation prompts from the Ask you have been invited to
  • AI-generated follow-up and clarifying questions
  • Confirmation and status messages related to your participation

Message Frequency: Message frequency varies by conversation, depending on the number of questions in the Ask and any follow-up questions.

Message and Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan.

Opt-Out: You can opt out of receiving messages at any time by replying STOP to any message from Spills Tea. You may receive a single message confirming your opt-out, after which you will no longer receive messages unless you opt in again.

Opt-In: After opting out, you can reply START to the Spills Tea number to allow messages again, and participate by texting an Ask code.

3. WhatsApp Terms

Responders may participate in Asks via WhatsApp by messaging an Ask code to the Spills Tea WhatsApp number. By doing so, you consent to receive WhatsApp messages from Spills Tea related to that Ask, of the same kinds described in Section 2.

Your use of WhatsApp is also governed by WhatsApp's own terms of service and privacy policy (WhatsApp is a Meta service). You can stop receiving WhatsApp messages at any time by replying STOP. Only text messages are supported; media, attachments, and other message types are not processed.

4. Fair Usage

Spills Tea is designed for genuine, good-faith participation. To keep the platform reliable and fair for all users, the following fair usage guidelines apply to Responders:

  • One response per Ask: Each Responder may participate in a given Ask only once. Duplicate or repeated responses to the same Ask may be discarded.
  • Authentic responses: Responses should reflect the Responder's honest input. Automated, scripted, or bot-generated replies are not permitted.
  • Respectful participation: Responses containing harassment, hate speech, threats, or content that is illegal, abusive, or deliberately disruptive are prohibited and may result in removal from the conversation and exclusion from future Asks.
  • No abuse of messaging: Responders should not send excessive, irrelevant, or unsolicited messages to Spills Tea outside the context of an active Ask session. Doing so may result in the Responder being blocked.

We reserve the right to limit, suspend, or terminate a Responder's ability to participate if we determine, in our reasonable judgment, that their usage is abusive, fraudulent, or otherwise harmful to the service or its users. Creators are responsible for distributing their Ask invitations to appropriate audiences.

5. Eligibility

You must be at least 13 years of age to use Spills Tea. If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian.

6. Accounts

Creating and previewing an Ask does not require an account, but you must create a Creator account to save an Ask, share it, and review responses. You agree to provide accurate account information and to keep your credentials secure. You are responsible for activity that occurs under your account.

7. Plans, Billing, and Payment

Spills Tea offers a free plan and paid subscription plans with different features and usage limits (such as the number of Asks, questions per Ask, and responses), as described on our pricing page. We may change plan features, limits, and pricing from time to time; changes to pricing will not apply retroactively to an already-paid billing period.

  • Payments: Payments are processed by Stripe. We do not store your full card details.
  • Subscriptions: Paid plans are billed on a recurring basis and renew automatically until canceled. Where offered, free trials convert to a paid subscription at the end of the trial unless canceled before the trial ends.
  • Cancellation: You can cancel your subscription at any time through your billing settings. Cancellation takes effect at the end of the current billing period, after which your account moves to the free plan.
  • Response Packs: Paid subscribers may purchase additional responses as one-time purchases. Purchased responses do not expire with the billing period.
  • Refunds: Except where required by law, payments are non-refundable.

8. User Responsibilities

By using Spills Tea, you agree to:

  • Provide accurate information, including a valid phone number (for Responders) or valid account information (for Creators)
  • Not use the service for harassment, spam, or any unlawful purpose
  • Not attempt to reverse-engineer, disrupt, or abuse the service
  • Respect other participants in any Ask you are involved in

9. Creator Responsibilities

Creators are responsible for the prompts they submit and the Asks they distribute. Creators agree not to use the service to collect sensitive personal information (such as Social Security numbers, financial account numbers, or health information) unless explicitly supported by the platform. Creators are responsible for informing Responders about the purpose of their Ask.

10. AI-Generated Content

Spills Tea uses artificial intelligence to generate questionnaires, facilitate SMS and WhatsApp conversations, and summarize and analyze responses. AI-generated content, including questions, follow-ups, summaries, and insights, is provided for informational purposes and may not always be accurate. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

11. Intellectual Property

All content, branding, and technology associated with Spills Tea are the property of Yardworks Labs, LLC. Responses you provide remain your own, but you grant us a non-exclusive, royalty-free license to use, process, and display your responses within the context of the service (e.g., presenting aggregated or summarized results to the Creator who initiated the Ask).

12. Privacy

Your use of Spills Tea is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

13. Disclaimers

Spills Tea is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.

14. Limitation of Liability

To the fullest extent permitted by law, Yardworks Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to any charges incurred from SMS messages.

15. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the service or by posting the updated Terms on our website. Continued use of the service after changes constitutes acceptance of the revised Terms.

16. Termination

We reserve the right to suspend or terminate your access to Spills Tea at any time, for any reason, including violation of these Terms.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
