Yardworks Labs, LLC ("we," "us," or "our") operates Spills Tea, a web-based platform for creating and collecting AI-powered questionnaire responses over text messaging (SMS) and WhatsApp. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our service.

1. Information We Collect

Information You Provide

  • Account Information: If you create a Creator account, we collect your email address, a password, and optionally your name.
  • Prompts and Ask Content: The prompts Creators submit and the resulting AI-generated Ask content. If you try Spills Tea without an account, the prompt you enter is processed to generate a preview, but the preview is not saved unless you sign up.
  • Phone Number: Collected when a Responder initiates a response to an Ask via SMS or WhatsApp.
  • Message Responses: The content of messages Responders send in response to Ask questions, over SMS or WhatsApp.
  • Responder Name: If an Ask is configured to collect names, the name a Responder provides at the start of the conversation.
  • Payment Information: If you purchase a paid plan or response pack, payment is processed by Stripe. We never receive or store your full card number; we store your subscription plan, billing status, and purchase records.

Information Collected Automatically

  • Message Metadata: Timestamps, delivery status, and message counts associated with SMS and WhatsApp interactions.
  • Device and Carrier Information: Carrier information associated with a Responder's phone number, as provided by our messaging infrastructure.
  • Usage Data: How you interact with the service, including Asks created, invites viewed, participation rates, plan usage counts, and session data.
  • Analytics Data: We use PostHog to collect usage analytics, including pages visited, interactions with the service, browser type, device information, and IP address. This data helps us understand how the service is used and improve the experience. PostHog may also record session replays, which capture anonymized representations of how you interact with the service (such as clicks, scrolls, and page navigation). Session replays do not capture passwords, payment information, or text entered into sensitive fields.

Information from Third Parties

  • Messaging Providers: We use AWS End User Messaging to send and receive SMS and WhatsApp messages. AWS may provide us with delivery and carrier-related metadata. WhatsApp messages are also transmitted through WhatsApp, a Meta service (see Section 4).
  • Payment Provider: Stripe provides us with subscription and payment status information (but not full card details).

2. How We Use Your Information

We use the information we collect to:

  • Deliver and operate the Spills Tea platform, including the web application and SMS/WhatsApp-based response collection
  • Generate AI-powered questionnaires from Creator prompts
  • Process Responder answers using artificial intelligence to generate follow-up questions, summaries, and insights for Creators
  • Communicate with Responders about their participation
  • Send Creators email notifications when responses arrive (you can opt out at any time; see Section 6)
  • Process payments and manage subscriptions and usage limits
  • Improve and develop the service
  • Comply with legal obligations and enforce our Terms of Service

3. AI Processing

Spills Tea uses artificial intelligence (Anthropic Claude models, accessed through Amazon Bedrock) to:

  • Generate questionnaires and invites from Creator prompts
  • Conduct conversations with Responders over SMS and WhatsApp, including generating follow-up and clarifying questions
  • Interpret and structure Responder answers, including recognizing when a Responder wants to stop
  • Summarize and aggregate responses and generate insights and charts for Creators
  • Generate illustrative preview content within the web application

AI processing is performed on a per-session basis. We do not use your individual responses to train AI models.

4. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • With Creators: Responder answers (which may be summarized or aggregated), along with the Responder's name if the Ask collects one, are shared with the Creator who initiated the Ask. Responses may be presented individually or in aggregate, depending on the Ask configuration.
  • Service Providers: We use third-party services to operate Spills Tea, including AWS (SMS and WhatsApp delivery, email delivery, hosting, and AI processing), Stripe (payment processing), and PostHog (analytics). These providers process data on our behalf under contractual obligations. PostHog may route certain analytics traffic through Cloudflare as part of its infrastructure for delivering analytics functionality.
  • WhatsApp / Meta: If you respond via WhatsApp, your messages are transmitted through WhatsApp and are also subject to WhatsApp's own terms and privacy policy.
  • Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

5. Data Retention

  • Message Content: Response data is retained for the duration of the Ask and a reasonable period thereafter to provide the service. Creators may access responses for as long as the Ask remains active.
  • Phone Numbers: Retained while a Responder's participation in an Ask is active. If a Responder opts out, we retain their phone number and opt-out status as needed to honor the opt-out, and delete it upon request.
  • Account Data: Retained as long as you maintain an active Creator account, or as required by law.
  • Ask Content: Retained as long as the Creator's account is active and the Ask has not been deleted.
  • Payment Records: Retained as required for accounting, tax, and legal purposes.

You may request deletion of your data at any time by contacting us at privacy@spillstea.com.

6. Your Choices

  • Opt Out of Messages: Reply STOP to any Spills Tea message — over SMS or WhatsApp — to stop receiving messages. For SMS, you may receive a single carrier-level confirmation of your opt-out; after that, we will not message you again.
  • Opt Back In: Text an Ask code to the Spills Tea number (or message it on WhatsApp) to participate again. If you opted out of SMS with STOP, reply START first to lift the block.
  • Email Notifications: Every response-notification email we send Creators includes an unsubscribe link, which lets you stop emails for that Ask or for all Asks. You can also manage notifications from your account.
  • Request Data Deletion: Contact privacy@spillstea.com to request deletion of your personal data.
  • Access Your Data: Contact us to request a copy of the personal data we hold about you.

7. Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, including encryption of data in transit and at rest. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Children's Privacy

Spills Tea is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us at privacy@spillstea.com so we can promptly delete it.

9. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including:

  • The right to know what personal information we collect and how it is used
  • The right to request deletion of your personal information
  • The right to opt out of the sale of your personal information (we do not sell personal information)
  • The right to non-discrimination for exercising your privacy rights

10. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you via the service or by posting the updated policy on our website. The "Last Updated" date at the top of this page indicates when the policy was last revised.
