Yardworks Labs, LLC ("we," "us," or "our") operates Spills Tea, a web-based platform for creating and collecting AI-powered questionnaire responses. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our service.

1. Information We Collect

Information You Provide

  • Account Information: If you create a Creator account, we collect your name and email address.
  • Prompts and Ask Content: The prompts Creators submit and the resulting AI-generated Ask content.
  • Phone Number: Collected when a Responder initiates a response to an Ask via SMS.
  • SMS Responses: The content of text messages Responders send in response to Ask questions.

Information Collected Automatically

  • Message Metadata: Timestamps, delivery status, and message counts associated with SMS interactions.
  • Device and Carrier Information: Carrier information associated with a Responder's phone number, as provided by our SMS infrastructure.
  • Usage Data: How you interact with the service, including Asks created, invites viewed, participation rates, and session data.
  • Analytics Data: We use PostHog to collect usage analytics, including pages visited, interactions with the service, browser type, device information, and IP address. This data helps us understand how the service is used and improve the experience. PostHog may also record session replays, which capture anonymized representations of how you interact with the service (such as clicks, scrolls, and page navigation). Session replays do not capture passwords, payment information, or text entered into sensitive fields.

Information from Third Parties

  • SMS Service Providers: We use AWS End User Messaging to send and receive text messages. AWS may provide us with delivery and carrier-related metadata.
  • Authentication Providers: If you sign in via a third-party provider (e.g., Google), we receive basic profile information as authorized by you.

2. How We Use Your Information

We use the information we collect to:

  • Deliver and operate the Spills Tea platform, including the web application and SMS-based response collection
  • Generate AI-powered questionnaires from Creator prompts
  • Process Responder answers using artificial intelligence to generate follow-up questions, summaries, and insights for Creators
  • Communicate with Responders about their participation, including opt-in confirmation, opt-out confirmation, and service notifications
  • Improve and develop the service
  • Comply with legal obligations and enforce our Terms of Service

3. AI Processing

Spills Tea uses artificial intelligence (powered by Amazon Bedrock) to:

  • Generate questionnaires from Creator prompts
  • Conduct SMS conversations with Responders, including generating follow-up questions
  • Summarize and aggregate responses for Creators
  • Detect response quality and relevance

AI processing is performed on a per-session basis. We do not use your individual responses to train AI models.

4. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • With Creators: Responder answers (which may be summarized or aggregated) are shared with the Creator who initiated the Ask. Responses may be presented individually or in aggregate, depending on the Ask configuration.
  • Service Providers: We use third-party services to operate Spills Tea, including AWS (SMS delivery, hosting, and AI processing), PostHog (analytics), and authentication providers. These providers process data on our behalf under contractual obligations.
  • Legal Requirements: We may disclose information if required by law, regulation, legal process, or governmental request.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

5. Data Retention

  • SMS Content: Response data is retained for the duration of the Ask and a reasonable period thereafter to provide the service. Creators may access responses for as long as the Ask remains active.
  • Phone Numbers: Retained as long as a Responder's participation in any Ask is active, or until the Responder opts out.
  • Account Data: Retained as long as you maintain an active Creator account, or as required by law.
  • Ask Content: Retained as long as the Creator's account is active and the Ask has not been deleted.

You may request deletion of your data at any time by contacting us at spillstea@yardworks.ai.

6. Your Choices

  • Opt-Out of SMS: Reply STOP to any Spills Tea message to stop receiving text messages. You will receive a one-time confirmation.
  • Opt Back In: Reply START or accept a new Ask invitation.
  • Request Data Deletion: Contact spillstea@yardworks.ai to request deletion of your personal data.
  • Access Your Data: Contact us to request a copy of the personal data we hold about you.

7. Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, including encryption of data in transit and at rest. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Children's Privacy

Spills Tea is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us at spillstea@yardworks.ai so we can promptly delete it.

9. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including:

  • The right to know what personal information we collect and how it is used
  • The right to request deletion of your personal information
  • The right to opt out of the sale of your personal information (we do not sell personal information)
  • The right to non-discrimination for exercising your privacy rights

We may update this Privacy Policy from time to time. If we make material changes, we will notify you via the service or by posting the updated policy on our website. The "Last Updated" date at the top of this page indicates when the policy was last revised.
